1. PURPOSE
This document establishes the General Terms and Conditions (hereinafter referred to as "Terms") governing the use of ground transportation services provided by Transportes Turísticos Allende (hereinafter referred to as "The Company"), based on the legal provisions of the Civil Code and Commercial Code of the State of Guanajuato, as well as applicable federal laws.
2. DEFINITIONS
Company: Transportes Turísticos Allende, responsible for the service.
Client: A natural or legal person who contracts the transportation services.
Driver: Authorized person to operate the transportation vehicle.
Passenger: Person transported through the contracted services.
3. DRIVER RESPONSIBILITIES
The driver agrees to comply with current traffic regulations in the State of Guanajuato and applicable federal laws.
The driver will not be responsible for delays caused by external factors such as traffic, weather, roadblocks, or unforeseeable mechanical failures.
In the event of a road accident, the driver must immediately notify the relevant authorities and the company.
4. MECHANICAL FAILURES AND EMERGENCIES
In the event of a mechanical failure during the trip, the following steps will be taken:
The driver will immediately notify the company and passengers.
A replacement vehicle will be provided when possible.
The company will not be responsible for missed flights, reservations, or other inconveniences resulting from mechanical failures.
5. PASSENGER RESPONSIBILITIES
The passenger must follow the driver’s instructions at all times.
The passenger will be responsible for their personal belongings.
Smoking, alcohol consumption, or illicit substances are prohibited inside the vehicles.
6. CANCELLATION AND REFUND POLICY
Cancellations must be made at least 24 hours in advance.
No refunds will be issued for cancellations outside the stipulated period.
In cases of force majeure, the company will evaluate possible partial refunds.
7. INSURANCE AND COVERAGE
All company vehicles have valid civil liability insurance in accordance with Mexican laws.
In case of an accident, the corresponding policies will apply, always respecting the legal and contractual guidelines of the insurer.
8. APPLICABLE LEGISLATION
These Terms and Conditions will be governed by the laws of the State of Guanajuato and applicable federal transportation legislation.
9. DISPUTE RESOLUTION
Any dispute arising from the interpretation or execution of these terms will be submitted to the competent courts of San Miguel de Allende, Guanajuato.
10. ACCEPTANCE OF TERMS
By contracting the services of Transportes Turísticos Allende, the client declares that they have read, understood, and accepted these Terms and Conditions.
